Terms of Service

These terms of service ("Terms") govern access to and use of targum. By accessing or using the Service the User accepts these Terms. A person who does not accept them must not use the Service.

Definitions

  1. "Operator" means David Langellotti, who operates the Service.
  2. "Service" means the software made available at targum.page, together with any page, interface or output forming part of it.
  3. "User" means any person who holds an account with the Service or who otherwise accesses it.
  4. "User Content" means any file, text or other material supplied to the Service by the User, together with any output generated from it for the User.

The Service

  1. The Service is provided in a pre-release form, by invitation, and without charge. No term of these Terms obliges the Operator to maintain the Service, to continue to provide it without charge, or to provide it at any particular standard of availability.
  2. Translations produced by the Service are generated by automated means and are not warranted to be accurate. Passages of low confidence are marked as such within the output. The User must not rely upon a translation for any purpose in which accuracy is material.
  3. The Operator may modify, suspend or discontinue any part of the Service, with or without notice.

Accounts

  1. The User is responsible for the security of the account and of the electronic mail address by which it is accessed.
  2. An account is personal to one natural person. The User must not permit another person to use the account.
  3. An account must be registered by a natural person. Registration by automated means is not permitted.
  4. The User is responsible for all activity occurring under the account.

User Content

  1. As between the parties, the User retains all right, title and interest in User Content. The Operator claims no ownership in it.
  2. The User grants the Operator a non-exclusive, worldwide, royalty-free licence to store, reproduce, transmit and process User Content, and to transmit it to the processors identified in the Privacy Notice, in each case solely to the extent necessary to provide the Service to the User. That licence terminates upon deletion of the User Content or closure of the account, whichever first occurs.
  3. Where a text is publicly available, a translation of it may be generated once and made available to every User who reads that text. User Content that is not publicly available is stored under the User's account alone and is not made available to any other User.
  4. The User warrants that the User is entitled to supply User Content to the Service and that doing so infringes no right of any third party.
  5. The Operator does not review User Content before it is processed. The Operator reserves the right, but assumes no obligation, to remove any User Content.

Intellectual property

  1. The translation pipeline is licensed under the GNU Affero General Public License, version 3 or later. The source is linked at the foot of every page.
  2. The catalogue, the works listed in it and the material accompanying them are not so licensed. Nothing in these Terms grants the User any right in a work beyond that granted by the person entitled to it.
  3. The name targum, the mark and the visual design of the Service remain the property of the Operator. Nothing in these Terms grants a licence to use them.

Notice of infringement

  1. A person who considers that material available through the Service infringes a right of that person may give notice in writing to hello@targum.page, identifying the material complained of.
  2. Upon receipt of such a notice the Operator shall remove the material complained of. No form of notice is prescribed and no fee is payable.

Suspension and termination

  1. The User may close the account at any time. The procedure and its consequences are set out in the Erasure and Account Closure Procedure and the Data Retention Schedule.
  2. The Operator may suspend or terminate an account where the User is in breach of these Terms, where the account is used against the Service or against another person, or where the Operator is required to do so by law.
  3. Abuse of, or a threat directed at, the Operator terminates the account immediately and without notice.
  4. Termination does not affect any right or liability accrued before it takes effect.

Disclaimer

  1. The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law the Operator excludes all warranties, conditions and terms implied by statute or common law, including any implied warranty of satisfactory quality, fitness for a particular purpose or non-infringement.
  2. The Operator does not warrant that the Service will be uninterrupted, secure or free from error, nor that any defect will be corrected.

Limitation of liability

  1. To the fullest extent permitted by law, the Operator shall not be liable for any indirect, incidental, special, consequential or exemplary loss, nor for any loss of profit, revenue, goodwill or data, arising out of or in connection with the use of or inability to use the Service, whether in contract, tort including negligence, or otherwise, and whether or not the Operator was advised of the possibility of such loss.
  2. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability which may not lawfully be excluded or limited.
  3. Nothing in these Terms affects the statutory rights of a User dealing as a consumer.
  4. The User is advised to retain an independent copy of User Content by means of the function styled "Download your words" upon the profile page.

General

  1. The Operator may amend these Terms. The date of the last amendment appears below, and continued use of the Service after that date constitutes acceptance of the Terms as amended.
  2. If any provision of these Terms is held to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in force.
  3. No failure or delay by the Operator in exercising any right constitutes a waiver of that right.
  4. These Terms, together with the Privacy Notice, the Data Retention Schedule and the Erasure and Account Closure Procedure, constitute the entire agreement between the parties in respect of the Service.
  5. The User may not assign or transfer any right under these Terms. The Operator may assign these Terms upon a transfer of the Service, notice of which shall be given to the User.
